High Court Won't Review $5B Vioxx Deal

Law360, New York (February 22, 2011, 4:16 PM EST) -- The U.S. Supreme Court declined Tuesday to hear a challenge to Merck & Co. Inc.'s $4.85 billion resolution of the multidistrict litigation over painkiller Vioxx brought by plaintiffs who claimed the mass settlement stripped them of their rights.

The Supreme Court denied a petition for certiorari filed by a group of plaintiffs who did not opt into the settlement, known as the Dier plaintiffs.
