Dollar General Workers Lose Cert. Bid In OT Action

Law360 (February 24, 2011, 2:59 PM EST) -- A group of former Dollar General employees lost out on a certification bid Wednesday in a collective action in New York accusing the discount store chain of failing to properly compensate workers for overtime.

Judge David G. Larimer of the U.S. District Court for the Western District of New York denied the six lead plaintiffs' motions for certification of a collective action brought under the Fair Labor Standards Act and for certification of their state law claims classes.
