Court Evicts Some SF Rent Measure Provisions

Law360, New York (February 24, 2011, 6:36 PM EST) -- A California appeals court Wednesday pared down a San Francisco voter initiative that allows the city’s rent board to order rent reductions against landlords who act in bad faith, saying the measure interfered with the judiciary’s powers.

The Court of Appeal of the State of California, First Appellate District, ruled that provisions in Proposition M enabling the San Francisco Rent Board to lower rents when landlords decrease housing services or harass tenants violated the judicial powers clause of the California Constitution.
