Classes Decertified In 24 Hour Fitness OT Suit

Law360, New York (February 25, 2011, 12:45 PM EST) -- A federal judge in California on Thursday decertified classes of 24 Hour Fitness USA Inc. trainers and managers who accused the gym chain of violating the Fair Labor Standards Act by refusing to pay them overtime.

Judge Samuel Conti of the U.S. District Court for the Northern District of California granted 24 Hour Fitness' motions to decertify the two conditional FLSA classes, ruling that both the trainers and managers had failed to provide substantial evidence they were similarly situated employees.
