Cobra Sex Supplement Action Survives Dismissal Bid

Law360, New York (February 28, 2011, 4:06 PM EST) -- A federal judge in California gave the green light Friday to a putative class action accusing Natural Balance Inc. of deceiving consumers about the efficacy and safety of purported aphrodisiac Cobra.

Judge Marilyn L. Huff of the U.S. District Court for the Southern District of California denied Natural Balance's motion to dismiss, saying the complaint, filed by Eileen Peviani, met heightened federal pleading standards and established federal jurisdiction under the Class Action Fairness Act.
