9th Circ. DADT Row Continues Despite Repeal

Law360, New York (February 28, 2011, 4:40 PM EST) -- Congress’ repeal of the U.S. military's controversial "don't ask, don't tell" rule barring openly gay service members won't halt litigation challenging the policy in the Ninth Circuit, both sides in the dispute made clear Friday.

Federal attorneys filed a formal brief asking the U.S. Court of Appeals for the Ninth Circuit to reverse an October order by Judge Virginia Phillips of the U.S. District Court for the Central District of California from declaring DADT unconstitutional and ordering an immediate halt to its enforcement.
