Pulte Faces Sanctions In Georgia Stormwater Suit

Law360, New York (February 28, 2011, 8:30 PM EST) -- A Georgia judge has imposed sanctions on PulteGroup Inc. for the destruction of electronic evidence in an environmental lawsuit over stormwater runoff from one of the homebuilding giant's subdivisions.

In a Feb. 9 order, Judge Jeffrey S. Bagley of the Superior Court of the State of Georgia, Forsyth County, largely accepted a special discovery master's report and recommendation that Pulte should shoulder attorneys' fees, costs and expenses that plaintiffs and third-party defendants have incurred pursuing the spoliation issue.
