Travelers Off Hook For PCB Cleanup Costs

Law360 (March 2, 2011, 7:17 PM EST) -- A New York federal judge ruled Wednesday that the Travelers Indemnity Co. has no duty to defend a real estate company against regulators' demands that it pay cleanup costs at a polychlorinated biphenyl-contaminated site.

Judge Charles Siragusa granted Travelers' motion for summary judgment in the U.S. District Court for the Western District of New York, finding that the policy unambiguously excluded coverage for pollution that is expected or intended by the insured.
