Texas Court Sides With State DOT In Contract Dispute

Law360, New York (March 2, 2011, 9:51 PM EST) -- A Texas appellate judge decided Tuesday that the Texas Department of Transportation did not have to compensate the construction company contracted to lay asphalt for $600,000 in additional road repairs.

Justice Bob Pemberton's opinion in the Texas Court of Appeals, Third District, affirmed a district court ruling that upheld the state agency's denial of the money to CCE Ltd., which shelled out the cash to repair roads damaged during the execution of a contract.
