Boeing Again Gets Investors' Dreamliner Suit Tossed

Law360, New York (March 8, 2011, 1:52 PM EST) -- An Illinois federal judge for the second time grounded a proposed class action accusing Boeing Co. of deceiving shareholders about the test and delivery schedule for the long-delayed 787 Dreamliner airplane, according to an order filed Monday.

But unlike her previous dismissal, Judge Suzanne B. Conlon of the U.S. District Court for the Northern District of Illinois nixed the suit with prejudice, finding the plaintiffs had committed fraud on the court for misrepresenting a confidential source.
