Yoplait Buyers Win Class Cert. In General Mills Suit

Law360, New York (March 8, 2011, 6:17 PM EST) -- A federal judge in California on Monday granted class certification to consumers alleging General Mills Inc. exaggerated the digestive health benefits of a Yoplait-brand probiotic yogurt, just days after rejecting the company’s summary judgment bid.

In a ruling from the bench, Judge Cormac Carney of the U.S. District Court for the Central District of California certified a class of Yoplait YoPlus purchasers claiming General Mills misled the public in marketing the product, according to an attorney for the plaintiffs.
