Black & Decker Workers Try To Revive OT Claims

Law360, New York (March 10, 2011, 7:46 PM EST) -- A sales employee for Black & Decker (U.S.) Inc. sought to revive allegations Thursday accusing the company of making him and other employees work off the clock, asking the Second Circuit to reverse the dismissal of the collective action claims.

J. Nelson Thomas of Thomas & Solomon LLP, a lawyer for the named plaintiff, told a panel in the U.S. Court of Appeals for the Second Circuit that a lower court “erred both in law and fact” in issuing summary judgment to the company.
