7th Circ. Revives Auxiant ERISA Action

Law360, New York (March 15, 2011, 4:59 PM EDT) -- The Seventh Circuit on Tuesday found that a lower court erred in dismissing a putative class action accusing Medical Benefits Administrators Group Inc., also known as Auxiant, of routinely denying claims for preauthorized medical procedures.

The U.S. Court of Appeals for the Seventh Circuit ruled that while the Employee Retirement Income Security Act of 1974 does not authorize the monetary relief sought by the named plaintiff, his complaint does set forth a plausible claim for declaratory and injunctive relief based on Auxiant’s alleged breach of its...
