BMW Beats Class Action Claims Over Stinky Solvent

Law360, New York (March 15, 2011, 4:39 PM EDT) -- A New Jersey federal judge on Tuesday again threw out a class action against BMW of North America LLC over a solvent used in the manufacturing of one of its luxury vehicle models that allegedly gives off a noxious odor over time.

Judge Dickinson R. Debevoise of the U.S. District Court for the District of New Jersey granted BMW's motion to dismiss, saying plaintiff Arthur Alban had not adequately fixed the deficiencies in his complaint.
