States, NYC Urge High Court To Allow GHG Suit

Law360 (March 16, 2011, 12:35 PM EDT) -- Six states and New York City on Friday filed a brief asking the U.S. Supreme Court to affirm a 2009 ruling that revived their climate change public nuisance lawsuit against five power companies over carbon emissions.

The coalition, including New York, California, Connecticut, Iowa, Rhode Island and Vermont, said in the 70-page brief in American Electric Power Co. Inc. v. Connecticut that states have frequently relied on common law public nuisance suits to address emerging threats to their citizens' health and safety.
