EA Can't Shake $400M Activision Countersuit

Law360, New York (March 16, 2011, 7:52 PM EDT) -- Electronic Arts Inc. will have to defend against Activision Publishing Inc.'s $400 million countersuit claiming EA helped derail its “Call of Duty” franchise by conspiring with two video game developers under contract to Activision, a California judge ruled Wednesday.

Judge Elihu Berle of the Superior Court of the State of California, County of Los Angeles, denied EA's demurrer on all but one count of Activision's five-count cross-complaint at a hearing Wednesday, an attorney for one of the parties confirmed.
