GAO Revives Landscaper's Bid For VA Cemetery Project

Law360, New York (March 17, 2011, 6:51 PM EDT) -- The U.S. Government Accountability Office on Monday sustained a protest from a landscaper claiming the U.S. Department of Veterans Affairs unfairly tossed its bid to landscape a California cemetery because its bid was lower than the department’s own estimate.

The VA could have reasonably determined that Miami-based A1 Procurement LLC’s bidding price to landscape the Golden Gate National Cemetery in San Bruno, Calif., was unrealistically low, but the department gave no indication in its bid award that it had performed that analysis, the GAO said....
