Law360, New York (March 25, 2011, 2:37 PM EDT) -- A Kentucky federal judge on Tuesday refused to dismiss an antitrust class action alleging cable provider Insight Communications Co. LP improperly forced consumers to rent cable boxes from the company, the latest ruling in wide-ranging litigation over the practice.
Judge Joseph H. McKinley Jr. of the U.S. District Court for the Western District of Kentucky denied Insight's second bid to dismiss the suit. The company won the dismissal of the initial complaint in June, but the court allowed the plaintiffs to amend their pleadings.
