Ill. High Court Says American Refund Closes Case

Law360, New York (March 25, 2011, 6:37 PM EDT) -- Illinois' high court on Thursday ruled that American Airlines Inc. defused a putative class action over baggage fees by giving the lead plaintiff a refund that she wanted to decline.

American successfully evaded the suit when it put a refund on the lead plaintiff's credit card, even though her lawyers were pursuing discovery and she did not want to drop the case, the Supreme Court of Illinois said in a 7-0 ruling.
