US Seeks To Bar Contractor's Lost Profit Claims

Law360, New York (March 25, 2011, 7:55 PM EDT) -- Federal attorneys asked the U.S. Court of Federal Claims on Thursday to bar a contractor from adding $13 million lost profit claims to a suit accusing the government of purposely delaying a $3.8 million construction contract to harm the company.

The government's motion said the lost profits alleged by Hammer LGC Inc. were not in any claim submitted to the contracting officer, that Hammer had not sought lost profits in its original complaint and that it had not revealed the existence of them in any discovery....
