Massey Triumphs In W.Va. Coal Dust Action

Law360, New York (March 25, 2011, 1:51 PM EDT) -- A West Virginia jury on Friday ruled in favor of Massey Energy Co. in a class action accusing the company of exposing students and faculty at an elementary school to toxic coal dust.

The jury in the Circuit Court of Raleigh County denied the plaintiffs a medical monitoring program over the alleged effects of coal dust from a silo near the school, a spokesman for Massey confirmed.
