Judge Grants Cert. In Acer False Marketing Suit

Law360, New York (March 25, 2011, 9:10 PM EDT) -- A California federal judge on Friday conditionally granted final certification of a nationwide class of about 1 million consumers in a suit accusing Acer America Corp. of knowingly selling laptops without enough memory to support their operating systems.

Judge Jeffrey White of the U.S. District Court for the Northern District of California granted the plaintiffs' motion for class certification on the condition that the class is amended to exclude consumers who have already returned their Acer laptops for a refund.
