5th Circ. Upholds Class Denial In Title Insurance Row

Law360, New York (March 29, 2011, 1:30 PM EDT) -- The Fifth Circuit on Monday published its opinion backing the denial of class certification in a Chicago Title Insurance Co. customer's suit alleging the company routinely denied mortgage borrowers a title insurance premium discount mandated under Texas law.

A three-judge panel with the U.S. Court of Appeals for the Fifth Circuit issued the opinion March 23, disagreeing with named plaintiff Emma Benavides that its earlier ruling in Mims v. Stewart Title Guaranty Co. went against a district court's certification decision.
