DC Resident's FCA Claims Killed In Vioxx Fight

Law360 (March 30, 2011, 7:19 PM EDT) -- A Louisiana federal judge on Monday dismissed a Medicaid recipient's false claims allegations in the multidistrict litigation over the painkiller Vioxx, ruling Merck & Co. was publicly accused of fraud before he filed the claims.

Judge Eldon E. Fallon of the U.S. District Court for the Eastern District of Louisiana dismissed relator Kenneth Walker's District of Columbia False Claims Act claims against Merck but left intact a claim under the D.C. Consumer Protection Procedures Act, which Merck did not seek to dismiss.
