Universal Denied Quick Win In Ringtone Copyright Case

Law360, New York (April 4, 2011, 6:31 PM EDT) -- Universal Music Group Records Inc. lost a summary judgment bid Friday in a copyright case against ring tone service Myxer Inc., with a California judge rejecting Universal's argument that Myxer doesn't qualify for the Digital Millennium Copyright Act's safe harbor provision.

In a 75-page ruling, Judge Gary A. Feess of the U.S. District Court for the Central District of California denied Universal's motion, holding that genuine issues exist as to whether Myxer's policies to prevent copyright infringement qualify it for safe harbor protection.
