Intel Dodges Class Action Over Benchmark Practices

Law360, New York (April 7, 2011, 8:07 PM EDT) -- Intel Corp. on Thursday won the dismissal of a California putative class action accusing the company of unfair business practices related to computer benchmarking programs.

Judge James Ware in the U.S. District Court for the Northern District of California agreed with Intel that remaining named plaintiff Dart Seasonal Products Inc. lacked standing for the injunctive and declaratory relief it was seeking because it wasn't alleging any “real and immediate threat that it will be wronged again by defendants in the same way.”
