Homeowner Ends Lowe's, National Gypsum Drywall Suit

Law360, New York (April 11, 2011, 7:35 PM EDT) -- An Arizona homeowner who accused National Gypsum Co. and Lowe’s HIW Inc. of selling defective drywall dropped a putative class action against the companies on Wednesday, but left the door open to file new claims.

Raymond Yee, a Yucca, Ariz., resident, lodged a stipulation in the U.S. District Court for the District of Arizona dismissing without prejudice claims he filed on behalf of all U.S. residents living in homes built with National Gypsum and Lowe’s drywall, which he claimed contained excessive sulfur.
