Arista Can't Change Lime Wire Damages Request: Judge

Law360, New York (April 11, 2011, 9:08 PM EDT) -- A New York federal judge ruled Monday that Arista Records LLC and other record companies suing file sharing company Lime Wire LLC for copyright infringement cannot change their statutory damages request to actual damages just one month before a trial.

Judge Kimba M. Wood in the U.S. District Court for the Southern District of New York said that Lime Wire would be “unduly prejudiced” if the record companies were allowed to change their damages request because it had already shaped discovery.
