9th Circ. Sides With Workers In Housing Deduction Case

Law360, New York (April 12, 2011, 5:05 PM EDT) -- The Ninth Circuit on Tuesday ruled that Bear Creek Orchards Inc. violated Oregon law by deducting the cost of on-site housing from the paychecks of a class of migrant workers, partially reversing a lower court's decision.

The U.S. Court of Appeals for the Ninth Circuit partially reversed the lower court's ruling, finding that Bear Creek had relied on the housing to have workers on hand to pick peach and pear orchards during a monthlong harvest.
