Guacamole False Ad Suit Can Proceed, Judge Says

Law360, New York (April 12, 2011, 7:27 PM EDT) -- The parent of Mexican food brand Mission Foods lost its bid Monday to dismiss a putative class action in California alleging the company misleadingly labeled a guacamole-flavored dip as guacamole and a bean dip as all natural.

The ruling by Judge A. Howard Matz of the U.S. District Court for the Central District of California, however, had a silver lining for Gruma Corp. Gruma was also accused of misleading consumers by labeling the products as having no transfat or cholesterol, being made in the “authentic tradition”...
