Suit Seeking To Rescind Toyota Settlements Survives

Law360 (April 12, 2011, 8:46 PM EDT) -- A federal judge in California refused Toyota Motor Co.’s request Tuesday to toss a putative class action accusing it of intentionally withholding information during discovery in other product liability suits and asking to rescind settlements with the company.

Judge George H. King in the U.S. District Court for the Central District of California ruled the plaintiffs had adequately notified Toyota of their intention to rescind settlements that had ended their previous product liability suits, allowing the immediate complaint to proceed.
