MetroPlus, HHC Evade State Claims In OT Action

Law360, New York (April 13, 2011, 4:45 PM EDT) -- A New York federal judge trimmed a putative wage-and-hour class action against MetroPlus Health Plan Inc. and New York City Health and Hospitals Corp. on Tuesday, exempting the providers from New York overtime provisions as political subdivisions of the state.

Judge Jed S. Rakoff of the U.S. District Court for the Southern District of New York granted the defendants' bid to throw out allegations under state labor law brought by two former MetroPlus health care marketing representatives without elaboration.
