Target Dodges Theft Prevention Workers' OT Action

Law360, New York (April 14, 2011, 1:14 PM EDT) -- An Illinois federal judge on Wednesday tossed a putative class action brought by an employee in Target Corp.'s asset protection division, ruling that the retailer’s anti-theft investigators were exempt from overtime pay requirements.

Judge John F. Grady of the U.S. District Court for the Northern District of Illinois granted summary judgment to Target and dismissed the putative class action, finding that the Fair Labor Standards Act's administrative exemption applied to the retail chains investigators.
