Chase Presses For Arbitration In Appraiser OT Action

Law360 (April 15, 2011, 3:45 PM EDT) -- JPMorgan Chase Bank NA took another stab Tuesday at compelling plaintiffs in a putative wage-and-hour class action in California to arbitrate allegations Chase misclassified its home appraisers as exempt from overtime pay.

Sharpening its attack after a failed arbitration bid in March, Chase claims that the two plaintiffs’ employment agreements require them to arbitrate the dispute and that they must do so on an individual basis, not on collective grounds, according to the motion filed in the U.S. District Court for the Northern District of California....
