Auto-Owners Asks Judge To Deflect Drywall Suits

Law360 (April 18, 2011, 6:09 PM EDT) -- Auto-Owners Insurance Co. asked a Florida federal judge Monday to rule the insurer does not have to defend KB Homes Inc. and its supplier against a lawsuit in Florida and three class actions in Louisiana over allegedly defective Chinese drywall.

A pollution exclusion clause in an Auto-Owners insurance policy with supplier American Building Materials Inc. precludes cleanup and other coverage for the allegedly defective Chinese drywall, according to court papers filed by the law firm Rywant Alvarez Jones Russo & Guyton PA, which represents Auto-Owners....
