2nd Circ. Nixes Suit Over University's Medicare Bills

Law360, New York (April 19, 2011, 4:59 PM EDT) -- The Second Circuit on Tuesday backed a lower court's dismissal of a qui tam suit accusing the University of Rochester Medical Center of fraudulently billing Medicare and Medicaid, also ruling that an attorney representing the whistleblower was rightly sanctioned.

According to the opinion, plaintiff Keith Johnson — a former medical resident at URMC's Strong Memorial Hospital — had missed a deadline when he appealed a New York federal court's decision to toss his case for failure to state a claim.
