Marketing Reps Hit Amerigroup With OT Class Action

Law360 (April 19, 2011, 7:40 PM EDT) -- Amerigroup Corp. was hit with a putative class action in New York on Monday that accuses the health insurer of wrongly denying overtime pay to its corps of marketing representatives.

The action filed by Andrea Burch in the Eastern District of New York claims that Amerigroup violated the Fair Labor Standards Act and state employment laws when it classified her and fellow marketing reps as outside salespeople exempt from overtime pay.
