Maxtor Nets Win In Defective Disk Drive Action

Law360, New York (April 21, 2011, 2:16 PM EDT) -- Maxtor Corp. won summary judgment Wednesday in a putative class action in California accusing the company of designing and selling defective hard disk drives.

The plaintiffs claimed Maxtor — which was acquired by Seagate Technology LLC in 2006 — marketed the allegedly defective drives between November 2003 and January 2011, and accused the company of breach of express warranty, violations of the California Consumer Legal Remedies Act, violations of California's unfair competitive and false advertising laws, and unjust enrichment, according to the order.
