Guggenheim Imposter Can't Shake $10M Suit

Law360, New York (April 22, 2011, 5:17 PM EDT) -- An accused grifter busted for posing as a member of the illustrious Guggenheim family failed Friday to derail a $10 million lawsuit in New York alleging he tarnished the famed name through a criminal investment scam.

U.S. District Judge Paul G. Gardephe largely rejected defendant David Birnbaum’s claim that Guggenheim Capital LLC and Guggenheim Partners LLC had failed to support allegations that Birnbaum and his company Dabir International Ltd. tried to dupe wealthy investors by pretending to belong to the Guggenheim clan.
