Whisteblower Suit Against Home Depot Beats Dismissal Bid

Law360, New York (April 22, 2011, 7:26 PM EDT) -- A California federal judge refused on Friday to toss a whistleblower suit alleging that Home Depot Inc. violated the Buy American Act by failing to disclose that it sourced items from China when it was awarded a U.S. General Services Administration contract.

U.S. District Judge R. Gary Klausner denied a motion to dismiss filed by Home Depot, ruling that the relators had "sufficiently alleged the elements necessary to plead both an implied false certification claim or an explicitly false claim under the [False Claims Act]."...
