Ex-Deloitte Atty Decries Pension Ruling In 2nd Circ.

Law360, New York (April 26, 2011, 5:35 PM EDT) -- A former Deloitte LLP attorney did not have to exhaust administrative remedies before filing a lawsuit accusing the company of shortchanging pension recipients, a lawyer for the plaintiff told the Second Circuit on Tuesday.

The case was filed under the Employment Retirement Income Security Act of 1974, alleging the company's pension plans incorrectly excluded waiting periods for joining the plan from the time used to calculate pension benefits. The company maintains there was nothing wrong with its calculations.
