GAO Nixes Protest Of National Guard Utility Contract

Law360, New York (April 29, 2011, 5:25 PM EDT) -- The U.S. Government Accountability Office announced Thursday it had denied MG Mako Inc.’s protest over a National Guard utility contract the construction and engineering company lost because it failed to acknowledge an amendment to the contract in its proposal.

In its decision, the GAO said the amendment should not have been left out of the proposal because it expressly obligated the contractor to cooperate with the utility company, and therefore affected the legal relationship between the two parties.
