DC Circ. Backs Calif. Emissions Regs For Carmakers

Law360, New York (April 29, 2011, 6:41 PM EDT) -- The D.C. Circuit on Friday tossed a challenge to the U.S. Environmental Protection Agency's decision to allow California to curb greenhouse gas emissions for automakers, citing a lack of jurisdiction.

A three-judge panel for the appeals court declined to weigh in on the U.S. Chamber of Commerce and National Automobile Dealers Association's challenge to the EPA's authority to grant California a waiver to set its own emission standards on new vehicles sold in the state, questioning the trade groups' standing.
