Netflix Gets Suits Nixed In DVD Rental Antitrust MDL

Law360, New York (May 2, 2011, 5:03 PM EDT) -- Netflix Inc. on Friday won the dismissal of two California suits in a multidistrict litigation accusing it of conspiring with Wal-Mart Stores Inc. to divvy up the market for online DVD rentals and sales.

The two suits — which are unlike other actions in the MDL because they are made up of plaintiffs who purchased online DVD rental subscriptions from nonparty Blockbuster Inc. — lacked antitrust standing to proceed with their claims as a matter of law, U.S. District Judge Phyllis J. Hamilton ruled.
