Air Force Contractor Wins Suit Over Severance Pay

Law360 (May 2, 2011, 7:44 PM EDT) -- The Armed Services Board of Contract Appeals ruled in favor of a U.S. Air Force contractor in a dispute over employees' severance payments made after the end of a radar systems service contract, according to an opinion made public Monday.

The dispute centers around a fixed-price contract between the Air Force and Arctec Services that allowed for a price adjustment if Arctec incurred costs related to its collective bargaining agreements, including severance pay, according to an April 15 opinion by ASBCA Administrative Judge Robert T.
