Texas High Court Bars Retaliation Suits Against Cities

Law360, New York (May 2, 2011, 7:59 PM EDT) -- The Texas Supreme Court said Friday that local governments cannot be sued for alleged retaliatory action against employees who file workers' compensation claims, reversing two lower court decisions in a suit brought by a former Austin, Texas, tax appraiser.

In the opinion, the state's high court broke with precedent it set in City of LaPorte v. Barfield in 1995, which held that the state's labor code waives the governmental immunity of political subdivisions for retaliatory discharge claims.
