SOX Doesn't Cover Employees' Media Leaks: 9th Circ.

Law360, New York (May 3, 2011, 7:54 PM EDT) -- The whistleblower provisions of the Sarbanes-Oxley Act do not protect employees who leak information to the news media, the Ninth Circuit ruled Tuesday, becoming the first appeals court to decide the issue and affirming a victory for Boeing Co.

Sarbanes-Oxley bars public companies from retaliating against employees who disclose evidence of fraud to three specific entities mentioned in the text of the legislation — federal or law enforcement agencies, members of Congress, or supervisors — but not the press, a three-judge panel held.
