Diesel Fights Ex-Manager's OT Class Action Claims

Law360, San Francisco (May 5, 2011, 8:29 PM EDT) -- Diesel USA Inc. urged a California federal judge on Thursday to toss a proposed overtime class action because the former assistant store manager who brought the suit had admitted to performing supervisory work.

Plaintiff Ryan Greko claims that the retailer routinely required its ASMs to handle job responsibilities that were nearly identical to those outlined in the job description for a floor supervisor — a nonexempt position — but failed to pay them overtime.
