Houston Didn't Breach $77M Airport Pact: Texas Court

Law360, New York (May 6, 2011, 3:02 PM EDT) -- A Texas appeals court on Thursday upheld a ruling that Houston did not breach a $77 million contract for the construction of an airport concourse by hiking up wage scales imposed on the project's contractors.

A three-judge panel ruled that any contractual breach on the city's part did not cause damages to Southern Electrical Services Inc., and that the subcontractor's interest claim under the Prompt Payment Act fails as a matter of law.
