9th Circ. To Review Class Cert. Denial In Hertz OT Case

Law360, New York (May 12, 2011, 3:21 PM EDT) -- The Ninth Circuit agreed Wednesday to weigh in on a California trial court’s refusal to certify a class of ex-Hertz Corp. managers claiming the car rental company illegally denied them overtime pay.

In a brief order, the court granted the plaintiffs’ petition to appeal the Feb. 24 order denying class certification. At issue is whether courts must determine if class members perform the same duties for the same length of time in order to certify a misclassification action.
